Allant General Privacy Policy
Allant is committed to protecting and respecting consumer privacy and consumer privacy choices. To achieve this goal, Allant has adopted the highest recognized standards in the direct marketing industry and has adopted company-wide compliance programs designed to implement this company goal.
The Direct Marketing Association's Privacy Promise
As a member of the Direct Marketing Association (DMA), Allant is a signatory to their "Privacy Promise" program. The Privacy Promise is a public assurance that all DMA members will follow certain specific practices to protect consumer privacy. Essentially, it defines practical privacy guidelines for list users, compilers, managers, brokers, owners, and the service bureaus and suppliers that support list processing. The guidelines discuss topics such as defining customers and prospects, how consumers can opt out of the list rental process, and whether marketers can offer "selective suppression" for their multiple brands and/or business units.
Allant does not rent, share, license, or otherwise market or provide access to customer/prospect lists unless engaged by the list owner for the explicit purpose of managing rental or other usage of their list. Allant licenses all of the commercially available suppression files for both direct mail and telemarketing, including among others the DMA's "Mail and Telephone Preference Service" (MPS and TPS), various private suppression files, and federal and state-based Do Not Call files (Florida, Oregon, etc.). These suppression files contain the names, addresses, and (where appropriate) phone numbers of individuals who do not want to be solicited by mail, telephone or both.
While running the DMA's suppression lists and private consumer preference lists is not required, such suppression is Allant's standard practice. As a signatory to the DMA's Privacy Promise, Allant strongly endorses the use of the DMA's MPS and TPS files and requests that its clients not prohibit the use of those files. For more information about the DMA's Privacy Promise, contact the DMA at 202 955 5030.
"Do Not Call" Suppression
Allant subscribes to the Federal Trade Commission's National Do Not Call Registry, the Direct Marketing Association's Telephone Preference Service file (TPS), as well as all available state Do Not Call files. Other private-source suppression files, such as Last Call and Private Citizen, are obtained as well, although these private providers are subject to change. A list of the providers of these files is available upon request.
Allant consolidates all of these Do Not Call provider files into an internal Do Not Call database. As a matter of standard operating procedure, Allant runs this internal Do Not Call database against all customer data files submitted for telephone appending. Records matching Allant's internal Do Not Call database are, depending on the client's request, either (1) suppressed or (2) automatically flagged with an indicator of 'D'. Clients may request custom processing outside of these standard procedures; however, they will be required to sign an Exception Services Agreement delineating the limits on Allant's liability associated with such custom processing.
Allant monitors state and federal websites, agencies, industry organizations and publications for additions, changes and updates to the various DNC provider files. Updates received from Do Not Call list providers are updated into Allant's internal database within 48 hours, with 95% of the files updated within 24 hours. Allant has a comprehensive verification routine in place to ensure that its internal Do Not Call database is accurate.
Mail and E-Mail Suppression
In connection with Allant's processing of address lists, Allant runs such lists against the DMA's Mail Preference List, commercially available mail preference files and any suppression lists that the Allant client may provide. When available, Allant will run e-mail lists against the DMA's E-mail Preference List and any commercially available e-mail preference files. Allant helps its customers comply with the CAN-SPAM Act of 2003 (Controlling the Assault of Non-Solicited Pornography and Marketing Act). This act established requirements for those who send commercial e-mail, spells out penalties for spammers and companies whose products are advertised in spam if they violate the law, and gives consumers the right to ask e-mailers to stop spamming them.
Legal Compliance
Allant complies with, to the extent applicable to its operations, the Federal Telephone Consumer Protections Act of 1991, the Federal Trade Commission's Telemarketing Sales Rule, the CAN_SPAM Act of 2003 and the rule regarding the Privacy of Consumer Financial Information (Regulation P) and other applicable federal and state laws and regulations.
Physical Security
Allant has appropriate security measures in place in our physical facilities to protect against the loss, misuse or alteration of any consumer information in our possession. Allant maintains security procedures to keep information we license and process from being accessed by any unauthorized person or business. All Allant associates are assigned the appropriate access to certain data and applications.
Additional documentation is available upon request.
Email Permission Marketing Policy
This permission marketing policy contains terms that are applicable to Allant, Allant’s clients, and our clients' customers. Allant provides the Prevalence Email Campaign Management Solution to deliver permission-based personalized communications to our client’s prospects and customers. Allant expressly forbids any of our clients from using our full-service Email Campaign Management Solution to deliver non-permission based or unsolicited commercial email unless you have a prior relationship with the marketer. The term "commercial email" as used in this permission marketing policy does not include administrative email such as shipping notifications, employee notices, notices required by regulation or law, invoices, account statements, order confirmations and other transactional and relationship email, as defined by CAN-SPAM.
How does Allant avoid "spam"?
Each client who uses Allant’s Prevalence Email Campaign Management Solution product enters into a service agreement with Allant agreeing to comply with our permission marketing policies, as well as all laws and regulations related to their email marketing activities. Allant investigates any complaint that a client is delivering non-permission based or unsolicited commercial email. For online registrations, Allant asks its clients to provide Allant with the online opt-in information for the email recipient who submitted a complaint that he or she received via email. This online opt-in information includes the following:
- the date and time the recipient opted in
- the Internet Protocol address of the machine from which the recipient opted in
Email addresses obtained through email append processing will be acquired through data source providers, whose email database was created through a documented process whereby users were given appropriate notice and choice for the inclusion of their email address in such email append processing, and where any and all requests from users contacted via a Permission Mailing (or any subsequent email communications) to be excluded from such mailings by a specific marketer have been honored and immediately suppressed from any future mailings
If the individual enrolled via postal mail or other written means, Allant may request its clients to provide the enrollment form, or if the individual opted in via the telephone, then Allant may request the script that was used to gain the individual’s permission. Reports of a client sending non-permission based unsolicited email without a prior business relationship may result in the suspension or termination of the client's access to Allant’s Prevalence Email Campaign Management Solution.
How does Allant protect your privacy?
Allant employs strict security measures to protect against the loss, misuse, and alteration of data placed on the Allant network. For additional details, review our Privacy Policy.
How can you stop a company from sending you more email?
Every Allant client using the Prevalence Email Campaign Management Solution to send commercial email must include in each commercial email message (i) clear instructions on how the recipient can unsubscribe from receiving future commercial email, and (ii) its physical address. Allant understands that many illegitimate online marketers use unsubscribe links to verify whether an email address is valid, but Allant does not allow the delivery of non-permission based or unsolicited commercial email through its Prevalence Email Campaign Management Solution. Therefore, if you follow the unsubscribe instructions in the email, Allant will work with the client to make sure that you do not receive future commercial email. Our clients are required to comply with any commercial email opt-out request in accordance with CAN-SPAM and all other applicable laws. If you have difficulty unsubscribing from a client's email campaigns using the instructions provided in the email message, or if you have questions regarding the opt-out mechanism, please contact us.
